These terms cover use of Moments (the Shopify app and related sites at moments.byhubo.com) provided by Entaspire LTD trading as Byhubo (“Byhubo” “we” “us”).

1. The service
Moments lets you schedule this week's offer on your Shopify homepage via the Theme Editor block Moments - Homepage hero. You set dates and publish. When the window ends the Moments block goes empty. It does not restore your previous theme hero — put that content back in Theme Editor if you still want it.
Proof shows served → clicks → heuristic orders for a window. That is not a guarantee of incrementality or attributed revenue.
Moments is not a popup. It is not email or SMS. Keep your existing tools (e.g. Klaviyo Attentive).
2. Your account and Shopify
You need a Shopify store and must install Moments through Shopify. You are responsible for your Shopify account theme changes and staff access. You confirm you have authority to install apps on that shop.
3. Acceptable use
Do not misuse the service probe it without permission infringe others' rights or use Moments for unlawful offers. We may suspend access if use harms the service or other merchants.
4. Plans and payment
Free to try — no card today. Starter at £79 a month is the intended price; we are not charging yet.
Your free days start when the first campaign goes live. We will tell you clearly before any paid plan begins.
When a paid Starter plan begins it is intended to run through Shopify Billing (Managed Pricing / app subscription) at £79 a month for one store. We do not take card details on moments.byhubo.com. Until that path is live these terms do not create a charge.
5. Theme Editor
You (or someone with theme access) add Moments - Homepage hero once in Theme Editor (Home → Apps). Moments does not silently rebuild your theme. Concierge help may be offered as capacity allows; it is not a guarantee of unlimited setup labour.
6. Intellectual property
Moments software marks and site content belong to Byhubo or its licensors. Your store content and offer creative remain yours.
7. Disclaimer and liability
The service is provided as available. We work to keep it up but we do not warrant uninterrupted access or that Proof will match any particular revenue outcome.
To the fullest extent allowed by law Byhubo is not liable for indirect or consequential loss or loss of profits arising from use of Moments. Nothing here limits liability that cannot be limited under applicable law (including for death or personal injury caused by negligence fraud or fraudulent misrepresentation).
While Moments is free of charge our aggregate liability for claims arising in any 12-month period is limited to £100 (or the total fees you paid us for Moments in that period if higher) except for liability that cannot be limited.
8. Termination
You may stop using Moments and uninstall the app via Shopify at any time. We may suspend or end access for breach of these terms or to protect the service or other merchants.
Uninstall does not restore a previous theme hero — use Theme Editor. After uninstall shop data we hold is handled under our Privacy policy and Shopify's shop/redact process subject to legal retention.
9. Changes
We may update these terms. Continued use after a posted change means you accept the updated terms except where the law says otherwise. If we introduce a paid plan we will say so clearly before any charge begins.
10. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction. That does not stop either party seeking urgent injunctive relief in another forum. If mandatory local law gives you rights that cannot be waived those rights still apply.
